Spousal maintenance is usually determined during a divorce or legal separation, which is already an emotionally charged time.

Judges use many variables to decide the amount and length of spousal maintenance, including:

  • The age of the spouse seeking maintenance
  • A spouse’s employment history and earning ability
  • The physical and emotional condition of the spouse seeking maintenance
  • The time needed to get employment education or training
